Kouevi lived in Togo. From 2001- 2005, Kouevi conspired to fraudulently obtain “diversity visas,” 8 U.S.C. 1153(c)), for at least 34 people through the American Embassy in Togo. The head of the scheme, Afolabi, paid fees for persons who were eligible for the diversity lottery and assisted them with their paperwork, requiring the applicants to falsely represent that others were their spouses or children, so that those individuals could obtain visas. Kouevi was responsible for false documents and tutoring participants to prepare them for Embassy interviews. Afolabi helped Kouevi fraudulently obtain his own visa and paid his costs to come to the U.S. The Department of Homeland Security arrested Afolabi for bringing young girls to the U.S. and forcing them to work at hair braiding salons, 16 hours a day, 6 to 7 days a week, for several years, without pay. They were also subjected to beatings and rape. Kouevi was convicted of conspiracy to commit visa fraud, 18 U.S.C. 371, and visa fraud, 18 U.S.C. 1546(a) and 2, and sentenced to 26 months imprisonment. Petitioner, a native and citizen of Jamaica, was convicted of illicit trafficking - an aggravated felony - and also of an offense under a state law relating to a controlled substance. The Department of Homeland Security began removal proceedings against Petitioner based on these offenses. Petitioner filed a responsive pleading seeking to terminate the removal proceedings or, in the alternative, to cancel removal. An immigration judge (IJ) denied Petitioner's motion to terminate and ordered Petitioner to be removed to Jamaica. The board of immigration appeals (BIA) affirmed. The First Circuit Court of Appeals denied Petitioner's petition for review, holding that Petitioner pled to possessing a controlled substance with intent to sell in violation of Conn. Gen. Stat. Ann. 21a-277(b), that the offense was a subordinate offense constituting "trafficking," and therefore, Petitioner was convicted of drug trafficking as defined by federal law. View "James v. In 2010, the Department of Homeland Security (DHS) began removal proceedings under the Immigration and Nationality Act (INA) against Petitioner. The notice asserted that Petitioner was removable on three separate grounds - child abuse, crime of violence, and sexual abuse of a minor. An immigration judge (IJ) ruled that Petitioner was removable on all three grounds asserted by DHS, and that, as an aggravated felon, Petitioner was ineligible for cancellation of removal. The Board of Immigration Appeals (BIA) affirmed. At issue was whether the endangerment offense to which Petitioner pled nolo contendere comprised an aggravated felony sexual abuse offense for purposes of the INA. The First Circuit Court of Appeals reversed the BIA's ruling insofar as it held that Petitioner was removable on the grounds that he was convicted of aggravated felony sexual abuse and that he was therefore ineligible for cancellation of removal, as Petitioner could not be held to have pled to an offense that fell within the sexual abuse rubric under the INA. Roye, a 58-year-old native of Jamaica, was admitted to the U.S. in 1984 as the spouse of a citizen. In 1992, he pled guilty to aggravated assault and endangering the welfare of a child by having sexual intercourse with his eight-month old daughter. The trial judge sentenced Roye to six to 20 years’ imprisonment but strongly recommended transfer into a psychiatric facility. Fourteen years later, DHS charged him as removable under 8 U.S.C. 1227(a)(2)(A)(iii). An Immigration Judge found that Roye granted for deferral of removal under the Convention Against Torture. The IJ emphasized testimony indicating “that mentally ill detainees and prisoners are often sexually and physically assaulted in the Jamaican prison system because of the nature of their mental illness” and that Roye will be homeless in Jamaica due to a lack of family ties. The BIA ordered immediate removal. The Third Circuit reversed, holding that the BIA must review the conclusion that the evidence demonstrates that Roye’s persecutors will physically and sexually abuse him in a manner that rises to the level of torture under the CAT, and decide whether Jamaican public officials will consent to or acquiesce in such abuse. Petitioner, a Honduran national, appealed the denial of his petition for a writ of habeas corpus. This appeal involved the constitutional separation of powers and the limited judicial role in the extradition of a foreign national. On appeal, petitioner contended that the United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment barred his extradition by the Secretary of State, that the murder of the victim constituted a political offense for which he could not be extradited, and there was no valid extradition treaty in force between Honduras and the United States. The court held that petitioner's first argument was not ripe because the Secretary of State has not yet determined whether he was likely to be tortured nor decided whether to extradite him, and his other arguments lacked merit. Accordingly, the court vacated in part and affirmed in part the denial of petitioner's petition for a writ of habeas corpus, lifted the stay of the extradition proceedings, and remanded with instructions to dismiss petitioner's claim under the Convention Against Torture. Petitioner, a Mexican citizen, petitioned for review of the BIA's decision that he was not eligible for waiver of inadmissibility because he was convicted of an aggravated felony. The court concluded that the crime of sexual battery under California law was categorically broader than the federal generic crime of "sexual abuse of a minor" because the California crime could be committed against a victim of any age, while the federal generic offense required proof that the victim was a minor. The court also concluded that none of the evidence the court was permitted to consider under the modified categorical approach established that petitioner's victim was a minor. Petitioner Baltazar Sosa-Valenzuela illegally entered the United States from Mexico in 1981 at the age of three, and became a lawful permanent resident in 1992. In 1994, when he was sixteen, he shot and seriously injured a gang member. He pled guilty to attempted murder in the second degree and to unlawful possession of a firearm by a juvenile. After a successful post-conviction ineffectiveness of counsel petition, the state district court amended Petitioner's guilty plea to first degree assault and crime of violence with a deadly weapon. In 1996, while Petitioner was in juvenile detention, the Immigration and Naturalization Service issued a show cause order, charging Petitioner as deportable because of his criminal conviction. The immigration proceedings were then delayed for several years, while Petitioner was released and successfully completed his parole. Petitioner conceded deportability but requested a section 212 waiver which was then available as a form of discretionary relief under federal law and an adjustment of status. Both forms of relief were granted by the IJ and then denied by the BIA. Petitioner appealed the BIA's decision and order of deportation on three grounds: (1) the procedural regularity of the BIA decision as a collateral attack on the IJ's waiver decision; (2) the merits of the BIA's decision to reverse the IJ's waiver, arguing that it conflicted with the Supreme Court's decision in "Judulang v. Holder," (132 S. Ct. 476 (2011)); and (3) the BIA abused its discretion in denying him an adjustment of status based on his marriage to an American citizen. Upon review, the Tenth Circuit found the BIA was not precluded from reviewing the IJ's waiver decision, but we must remand to the BIA so that it may evaluate its decision in light of the Supreme Court's ruling in "Judulang." Medina first entered the U.S. illegally, at age 16, in 1982. He was deported after two 1989 convictions, one for selling or transporting cocaine and the other for attempted robbery. He returned and was convicted of illegal reentry and again deported. He entered unlawfully a third time and was convicted of being found in the United States in violation of 8 U.S.C. 1326(a). He appealed the 37-month sentence he received, contending that he should not have received a sixteen-level enhancement for being deported after a felony conviction for a “drug trafficking offense” where the imposed sentence exceeded 13 months or after a felony “crime of violence.” Medina argued that his 1989 convictions did not fall within those definitions under the 1989 edition of the United States Sentencing Guidelines and so the enhancement does not apply. The Seventh Circuit affirmed; the crimes qualify under the 2010 Sentencing Guidelines, which were the guidelines in effect at the time of Medina’s sentencing. View "United States v. Defendant Armando Ramos attacked the legal validity of his sentence for receipt of child pornography. Defendant was indicted by a federal grand jury in Kansas on two counts relating to the receipt and possession of child pornography. The charges arose out of an investigation that began with a tip from German authorities who were "policing the [e]Donkey peer-to-peer file sharing network and observed a known child pornography file available for download" at an IP address that was later traced by Immigrations and Customs Enforcement (ICE) to Defendant. ICE executed a search warrant at Defendant's home, seizing multiple computers, hard drives, DVDs, and CDs containing thousands of images and videos of child pornography. During the search, an investigator interviewed Defendant who then admitted to being the sole user of the computers in his home, and to using eMule, the "specific program that . . . access[es] the [e]Donkey network," as a vehicle for obtaining child pornography. On appeal, Defendant raised multiple objections to his presentencing report (PSR). He also raised an issue that the mandatory-minimum provision of 18 USC 2252(b)(1) was unconstitutional. Upon review, the Tenth Circuit rejected Defendant's challenge to the sentence he received, and concluded that that he could not establish that his sentence was affected by application of the mandatory minimum of 18 USC 2252(b)(1). Petitioner, a native and citizen of Honduras and a lawful permanent resident alien of the United States, petitioned for review of the Board of Immigration Appeals' (BIA) order dismissing his appeal from an immigration judge's order finding him removable as an alien convicted of an aggravated felony. At issue before the Ninth Circuit Court of Appeals was whether Petitioner's conviction under Article 92 of the Uniform Code of Military Justice qualified as an "aggravated felony" under the modified categorical approach as explained in the Court's recent en banc decision in United Sates v. Aguila-Montes de Oca. The Court granted the petition, concluding that Petitioner's Article 92 conviction was not an aggravated felony and Petitioner was therefore not removable.
